User Obligations and Responsibilities

3. Client Responsibilities for Service Delivery

When engaging our cleaning services, you are responsible for:

• Informing us of any hazards, security protocols, or special requirements
• Ensuring the premises are secure and that valuable items are properly stored
• Providing necessary utilities (water, electricity) during service delivery
• Notifying us promptly of any concerns or issues with service quality
• Ensuring timely payment according to agreed terms

Liability and Warranties

1. Service Warranties

We warrant that:

• Our services will be performed with reasonable care and skill
• Our staff are trained in commercial cleaning practices
• We maintain appropriate insurance coverage for our operations
• We comply with relevant health and safety regulations

However, we do not warrant that our services will be uninterrupted or error-free, or that they will meet all your specific expectations beyond what is agreed in your service contract.

2. Disclaimer of Warranties

To the fullest extent permitted by law:

• Our website and services are provided on an "as is" and "as available" basis
• We make no representations or warranties of any kind, express or implied
• We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that our website will be secure, error-free, or free from viruses

3. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you for services in the twelve months preceding the claim

Insurance Coverage

Ashford Facilities maintains appropriate insurance coverage, including:

However, clients are advised to maintain their own insurance coverage for their premises and property. We recommend reviewing your insurance policy to ensure adequate coverage for commercial cleaning services.

Claims for loss or damage must be reported to us within seven days of discovery. Late reporting may affect our ability to process claims through our insurance.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

• Acts of God, including severe weather conditions, floods, earthquakes, or other natural disasters
• War, terrorism, civil unrest, or government actions
• Strikes, labour disputes, or industrial action
• Pandemics, epidemics, or other public health emergencies
• Failure of utilities or telecommunications
• Any other events beyond our reasonable control

In such circumstances, our obligations will be suspended for the duration of the force majeure event, and we will endeavour to resume services as soon as reasonably practicable.

Assignment
